Landlord Rental must be fit to live in; that is, it must be habitable. in legal terms, “habitable” means that the landlord rental is fit for occupation by human beings and that it substantially complies with state and local building and health codes that materially affect tenants’ health and safety. Each state’s law makes landlords and tenants each responsible for certain kinds of landlord rental repairs, although landlords ultimately are legally responsible for assuring that their landlord rentals are habitable.
Before renting a landlord rental to a tenant, a landlord must make the landlord rental fit to live in, or habitable. Additionally, while the landlord rental is being rented, the landlord must repair problems that make the landlord rental unfit to live in, or uninhabitable. A landlord must repair substantial defects in the landlord rental and substantial failures to comply with state and local building and health codes. Landlord rental must be maintained to keep it liveable. The responsibility of serious repairs to landlord rental is determined by the rental agreement.
Landlord rental must be maintained by tenants and they are required by law to take reasonable care of the landlord rental. Tenant’s must keep the landlord rental’s common areas such as hallways and outside area clean and undamaged. If a tenant or their family or guests or pets cause damage to landlord rental due to neglect or abuse, they are responsible for the repair of the landlord rental
