Foreclosure Second Procedure

If the landlord and its lender or rental property owner and its lender or its servicing agent cannot agree on alternative mortgage loan terms to avoid foreclosure (a modification or restructuring), their lender can direct the trustee to record a NOD against their home provided that they have been contacted 30 days in advance of the recording in the manner described in Event 1. The recording of the NOD officially begins the foreclosure procedure. The landlord and rental property owner will receive a copy of the NOD by certified postage prepaid mail.

After the landlord or rental property owner’s lender or its servicing agent directs the trustee to record the NOD, an initial minimum three month period is required to provide them with the opportunity of curing the default and reinstating their mortgage loan. Landlords and rental property owners should use this time to bring current their delinquentpayments (reinstate) or to continue negotiating with their lender or its servicing agent a modification or restructuring of your mortgage loan. It may be possible to arrange with their lender or its servicing agent for a delay in payment (forbearance).
